Maria Cristina Franchini is a co-founding partner of De Berti Jacchia Franchini Forlani and head of the litigation team.
Previously, she spent a teaching period at Genoa State University, and worked at Studio Graziadei, then the leading international law firm in Italy.
Maria Cristina’s areas of concentration are domestic and cross-border litigation, private international law, IP law and litigation, licensing and commercial.
In the recent years, Maria Cristina masterminded the defense of various patented active principles belonging to Big Pharma multinationals, as well as of renowned luxury and fashion brands.
She has been in charge of a number of multi-jurisdiction litigations in contractual, insurance and corporate cases.
She is familiar with criminal and public law aspects, and has developed proven skills of multidisciplinary work in coordination with criminal and administrative law counsels, foreign lawyers, forensic economists, experts and consultants.

Assisting and representing on continuous basis the Italian subsidiary of the worldwide leading supplier of IT services for the travel and tourism markets, in various contentious cases in the Milan Court, including a dispute related to claims raised on several agreements for the supply of a multifunctional platform. Complex technical IT issues are being dealt with in the instruction phase of the proceedings. Attachment proceedings are pending (amongst others, on trademarks owned by the counterparty).

Representing a major Taiwanese company quoted on the Taiwan Stock Exchange, which operates in the solar power industry. The dispute involves parallel court proceedings in Italy, Luxembourg and Taiwan and international commercial arbitration proceedings in Singapore under the Singapore International Arbitration Centre Rules.
The subject matter of the dispute arises out of joint venture agreements entered into by the Taiwanese company and two other partners (a Singapore company and a Taiwanese company) and the control of the Italian subsidiary companies which own a number of photovoltaic plants. Central questions concern the jurisdiction of the arbitral tribunal and of the courts, the validity of a capital increase carried out by a Singapore holding in Luxembourg and the control of the Italian subsidiaries as a consequence, and the recovery of significant investments made by the Taiwanese company into the joint venture.
The proceedings cover a broad range of legal areas, including the validity and efficacy of agreements governed by different laws, the existence of alleged forged documents, the validity of corporate resolutions under different laws, relationships between arbitral and ordinary jurisdiction and procedural aspects. The Italian litigation has given rise to interim provisional remedies and complex enforcement proceedings, including the garnishment of future income.
The interim provisional measures obtained by the Firm have been confirmed by final judgments on the merits.

Represented for many decades a leading UK/US Big Pharma multinational in defending its patents and active principles in Italy. There have been cases, inter alia, in the Rome Court of Appeal as an aftermath of a series of patent cases and Supreme Court judgments won in the past against several infringers (of an anti-ulcer patent and active principle). All judgments rendered were favourable to the multinational and other companies belonging to the Group and became final during 2016.

Assisting and representing a Hungarian producer of a famous liqueur, in final settlement negotiations with a German company. The settlement closed a case on the validity of a trademark (reproducing a stag’s head) owned by the producer, which lasted for decades and involved a series of nullity and cancellation proceedings brought by the German company at all levels of jurisdiction, successfully defended on behalf of the Hungarian producer.
