Italy is the European country with the highest number of trade secret disputes. According to an EUIPO study, between 2017 and 2022, approximately 700 legal proceedings were recorded in the EU, with Italy leading the ranking. These disputes mainly involve employers and former employees, while cases against third-party companies are less frequent.

Jacchia, who highlighted the role of arbitration as an alternative dispute resolution tool: "Compared to court litigation, arbitration is characterized by a more flexible, streamlined, and faster procedure. Additionally, the parties can freely choose the arbitration venue and applicable rules, confidentiality is absolute, and arbitrators can be selected from experts with technical knowledge in the relevant field."
