Milan, June 30, 2022 – De Berti Jacchia, with a team led by Partner Prof. Fabio Ferraro, assisted Francesca Corneli, as a shareholder of Banca Carige, against the European Central Bank, (ECB), in the so-called “battle” of the former Carige shareholders against the commissioner of the Ligurian bank in 2019.
The Union’s Court ruled in favour of the former shareholder in a highly symbolic judgment, striking down the ECB for having denied access to the documents by which Carige was placed under extraordinary administration, annulling the rejection order and thus condemning the ECB to pay the legal costs of the appeal brought by a small shareholder, Francesca Corneli.
The ruling not only contains important statements of principle but is also destined to produce relevant effects on a practical level, as it requires the ECB to adequately justify its decisions and to verify, in concrete terms, the confidential nature of the documents and information requested by a bank’s shareholders.
